1. Privacy Policy
This policy describes how GausHaus ("we," "us") collects and uses information on GausHaus.com.
What we collect
- Booking information you submit: name, email address, phone number, property address, appointment preferences, and any notes you provide through our scheduling form.
- Technical information: our web host may automatically log standard server data (IP address, browser type, pages visited) for security and operations. We do not use analytics trackers or advertising cookies, and this site does not set cookies.
- Third-party resources: this site loads fonts from Google Fonts; your browser's request to Google discloses your IP address to Google, subject to Google's privacy policy. When you enter a property address in the booking form, your browser sends that address to the U.S. Census Bureau's public geocoding service to verify it; no other booking information is included in that request.
How we use it
- To schedule, confirm, and perform property capture services you request.
- To communicate with you about your appointment, quote, and deliverables.
- To comply with legal obligations and protect our legal rights.
Property capture data
When we capture a property we create scans, 3D models, photography, video, floorplans, and extracted property data ("Capture Data"). As described in Section 3 of our Terms, Capture Data is owned by GausHaus in perpetuity and may be used, shared, licensed, exchanged, or sold to other entities at our discretion, for free or for value. Interior imagery can incidentally include personal belongings — please remove or disclose anything you do not want captured before the appointment.
What we don't do with your contact information
- We do not sell or rent your contact information (your name, email address, and phone number submitted through the booking form).
- We do not share your contact information with third parties except service providers necessary to operate (e.g., our email and web hosting providers) or where required by law.
- Property Capture Data is separate from your contact information and is handled as described above and in our Terms.
Retention & your rights
We retain booking correspondence for our business records. You may request access to, correction of, or deletion of your personal information at any time by emailing Contact@GausHaus.com. Depending on your state of residence (including under the California Consumer Privacy Act and similar state privacy laws), you may have additional rights, including the right to know what personal information we hold and to request its deletion, free from discrimination for exercising those rights.
Children
Our services are directed to real estate professionals. We do not knowingly collect information from children under 13.
2. Terms of Service
The service
GausHaus provides on-site property capture using its proprietary capture technology and delivers media and data products including 3D gaussian splat tours, floorplans, photographs, and RESO-formatted property data ("Deliverables").
Booking & quotes
- Submitting the scheduling form is a request, not a confirmed appointment. Appointments are confirmed by our reply.
- Website calculator prices are estimates based on the size information you enter. The final fee is confirmed at booking and may be adjusted if actual square footage or acreage differs materially from what was submitted.
Property access & authorization
- By booking, you represent that you are authorized to grant us access to the property and to have it scanned, photographed, and measured — including, where you are not the owner, that you have the owner's permission (e.g., under your listing agreement) — and that you have obtained all consents necessary for GausHaus to own and use the resulting Capture Data as described in Section 3.
- You are responsible for preparing the property and disclosing hazards, occupancy, pets, and access requirements.
- We may capture and process images of the property's interior and exterior. Please remove or disclose any items you do not want captured; we will make reasonable efforts to accommodate written requests made before the appointment.
Payment, rescheduling & cancellation
- Payment terms, accepted methods, and any deposit are stated in your booking confirmation.
- Appointments may be rescheduled or cancelled without charge with at least 24 hours' notice. Late cancellations or on-site access failures (e.g., we cannot enter the property) may incur a trip fee stated in your confirmation.
- Weather affecting exterior or land capture may require rescheduling at no charge.
3. Media Ownership & License
- Ownership: all scans, 3D models and gaussian splat data, photography, video, floorplans, measurements, extracted property data, and every other media or data product created in connection with a capture (collectively, "Capture Data") are and remain the sole and exclusive property of GausHaus LLC, in perpetuity.
- Your license: upon receipt of full payment, you receive the photo, floorplan, and data Deliverable files together with a license to use them for marketing the captured property, your listing portfolio, and your own professional promotion. Deliverables may not be resold as stock media or sublicensed to unrelated third parties without written consent.
- GausHaus's rights: GausHaus may use, reproduce, modify, distribute, publicly display, license, sell, exchange, or otherwise commercialize Capture Data at its sole discretion, including sharing it with other entities for free, in exchange for other value, or for profit.
- Tour hosting: the 3D splat tour is hosted by GausHaus and included at no charge for the life of the associated listing (from capture until the listing sells, closes, is withdrawn, or otherwise terminates). Hosting beyond the listing period is not guaranteed and, if desired, may be arranged separately; hosted tours may be archived after the listing period ends.
- Until full payment is received, no license is granted and all Deliverables remain solely with GausHaus.
4. Measurement & Data Accuracy Disclaimer
Important: All floorplans, square footage figures, room dimensions, acreage figures, and RESO-formatted data fields are approximations generated from scan data and are provided for marketing and convenience purposes only.
- Deliverables are not a survey, appraisal, inspection, or engineering document, and GausHaus is not a licensed surveyor, appraiser, or inspector.
- Square footage may differ from figures produced under ANSI or other measurement standards, from tax records, or from appraisal measurements.
- You and any buyer, agent, lender, or MLS user should independently verify all measurements and data before relying on them. You are responsible for compliance with your MLS's rules and your state's real estate advertising regulations when publishing Deliverables and data.
5. Communications
By submitting the scheduling form you consent to receive transactional emails (and calls or texts, if you provide a phone number) about your booking. We do not send marketing email unless you separately opt in, and any marketing email will include a working unsubscribe mechanism as required by the CAN-SPAM Act.
6. Limitation of Liability
To the maximum extent permitted by law: (a) the service and Deliverables are provided "as is"; (b) GausHaus's total liability arising out of or relating to any capture or Deliverable is limited to the amount you paid for that capture; and (c) GausHaus is not liable for indirect, incidental, consequential, or special damages, including lost profits or lost transactions, arising from use of the Deliverables or from approximate measurements or data. Nothing in these terms limits liability that cannot be limited under applicable law.
7. General
- These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in San Diego County, California.
- GausHaus is operated by GausHaus LLC, 16950 Via de Santa Fe, Rancho Santa Fe, CA 92067.
- We may update this page from time to time; the effective date above reflects the latest revision. Material changes will be posted here.
- If any provision is found unenforceable, the remainder stays in effect.
